The Supreme Court upheld the Nevada Supreme Court’s ruling Friday blocking Green Party candidate Jill Stein from appearing on the state’s ballot for the 2024 presidential election.
The Democratic Party originally sued to remove the Green Party from the presidential ballot for paperwork violations. They alleged that the Green Party included inappropriate language on its signature ballot petition making the signatures on that document void.
Stein addressed the Democratic suit back in June, calling it “undemocratic.”

“The anti-democratic party has just gone on the attack,” Stein said. “The Green Party in Nevada and volunteers in Nevada collected 30,000 signatures, incredible, 30,000 signatures in Nevada, three times the number of signatures that’s required in the state.”

A state court ruled against the Democratic Party originally. The case then went to the Nevada Supreme Court, which found that the Nevada secretary of state’s office sent the Green Party the wrong paperwork, calling it “an unfortunate mistake.” The court also ruled that removing Stein’s name due to the error would not violate the Constitution.

Nevada’s secretary of state is Cisco Aguilar, a Democrat touted as an “election defender” by Time Magazine for championing a bill making it a felony to dox or “harass” election poll workers. (RELATED: Former Clinton Pollster Rips Dems For Trying To ‘Knock Off’ RFK Jr From Ballot)
Nevada is already printing ballots for the election Nov. 5, according to state officials. The deadline for sending out overseas ballots is Saturday.
The Democratic Party filed a similar legal challenge seeking to remove Stein from the ballot in the swing state of Wisconsin but was blocked by the state’s Supreme Court. “270toWin,” a political website, lists both Wisconsin and Nevada as toss-up states in the 2024 election. RealClearPolitics’ aggregate polling for Nevada favors Kamala Harris over Donald Trump by a marginal 0.2 points in a head-to-head matchup as of Friday.
Democratic PACs have also sued independent candidate RFK Jr. On Aug. 13, a New York judge disqualified Kennedy from running in the state, concluding that Kennedy had lied in his nominating petitions by claiming residence in New York when he really lived in California. Democratic Party-aligned PAC Clear Choice Action originally brought the lawsuit. This same PAC also introduced legal challenges in Pennsylvania and Illinois.
Additonally, Democrats have challenged Kennedy in Nevada, North Carolina, Delaware and New Jersey.
In Montana, Democrats targeted the Green Party’s senatorial candidate Robert Barb. The Montana Democrat Party alleged in its lawsuit that the Green Party had violated Montana law by waiting too long to replace the party’s primary winner Michael Downey, who stepped down Aug. 12.
Incumbent Sen. Jon Tester is being challenged by Republican Tim Sheehy, who leads the senator 49% to 41%, according to a new poll by AARP Montana.
Sheehy leads Tester 51% to 45% when there are no third party candidates on the ballot, according to the poll.

Michigan Secretary of State Jocelyn Benson and a Democrat super PAC affiliate brought suits against independent candidate Cornel West in that state. A week after West was disqualified, a judge overturned the ruling forcing West to appear on the ballot. DNC official David Strange, the individual who also filed in Wisconsin against Stein, filed a complaint with the Wisconsin Election Commission against West.
Marc Elias, DNC figurehead and Clinton lawyer who paid for the Steele Dossier, threatened to sue Virginia’s Republican governor, Glenn Youngkin, on Sept. 9 if the governor did not “immediately” remove West from the ballot. Elias stated that he was writing “on behalf of Clear Choice Action,” the same Democrat super PAC behind many of the Kennedy and Stein suits.
Democrats also brought a suit in the state of Alaska to stop a fellow Democrat from appearing on the ballot. The Alaska Democrat Party challenged the eligibility of Eric Hafner to appear on the ballot, arguing that his criminal conviction made him ineligible to run under the state’s laws and the Constitution. Alaska has Ranked Choice Voting, meaning more than one candidate from the same party can be selected per office.
